Agreement Property Browser will provide: You
agree that in all other respects the responsibilities of selling your
property are yours and that the Property Browser Service is strictly limited
to these Terms. You agree to use the Service strictly in accordance with
these Terms. You confirm that you have read the advertising and safety
guidelines set out in the Property Browser website. Property Browser is a publishing medium enabling you to privately advertise properties for sale or rent and is not in any capacity acting as agent in respect of the property. We make no guarantee regarding the accuracy of the information presented on this website. You confirm that any details, description, information and images submitted on the website are accurate and contain no false statements, misrepresentations or omissions which may mislead interested parties over the availability, condition or location of the property. You agree that you are solely responsible for the content, accuracy and completeness of any advertisement that you post on the website. Indemnification Termination User Conduct You are required to make payments as specified in the advertising fees to keep your advertisement live. In order to keep our database up-to-date, we reserve the right to delete any properties from our database that have not been renewed. Should we be unable to contact you via the current e-mail address you provide on your advertisement, and it appears this e-mail is no longer functioning, we reserve the right to delete your property without liability to us. You agree and understand that it is your responsibility to inform Property Browser to request deletion of your advertisement as soon as the property is no longer available. Renewed property adverts will remain on Property Browser until sold (if property is for sale) or you require it to be deleted. All adverts carry the same advertising fees as outlined on the website (including rentals). In the event that the fee is not paid within 30 days the advertisement will be removed from the database. User may terminate the service upon notice to this website at any time; however, user will not receive a refund of any portion of fees paid. If you contact us to request the deletion of the property, we can only remove your property with proof that you are the original advertiser. You understand that it is essential to provide a working and correctly submitted e-mail address in order to receive any enquiries from interested parties and communications from Property Browser. You are responsible for checking that your contact details on your advert are correct and kept up-to-date at all times to ensure enquiries reach you. Property Browser cannot be held responsible for any e-mail problems you experience, whether a result of your Internet Service Provider, the Internet or any other technical issue. You agree that Property Browser gives you the option to display your property house name/number and street name with your property. You understand that by publishing these details you may get interested parties calling at your house. If you have a concern about security, we recommend you do not publish your house number and street name. Should you post an advertisement and change your mind for any reason before you have paid, please contact us and we will remove your advertisement from our database. You will not be charged. You are solely responsible for: Dealing with enquiries in relation to your Property; Agreeing the advertised price of the Property; Vetting potential buyers; Conducting viewings; Following up enquiries you receive; Negotiating price; Instructing your solicitor. You acknowledge and agree that if you choose not to display your email address or telephone number and use the default "Request Contact Details" you may receive emails from interested parties via the Property Browser messaging system and that your email address will remain hidden until you respond to any such emails. You understand that any enquiries you receive via the messaging system are removed from the site after 90 days but can be retrieved before then by contacting customer support. You acknowledge and agree that you are solely responsible for managing any relationship (if any) you may have with Estate Agents in respect of the property and shall be liable for all fees or other payments that may be due to such agents as a result of the sale of the Property in accordance with the terms of such relationship. You understand that Property Browser cannot guarantee a buyer (properties for sale) or tenant (rental properties) as a result of submitting the property to Property Browser, nor can Property Browser guarantee enquiries or the legitimacy of enquiries. Please note that we are unable to refund for any reason, (including a change in your property circumstances, for example, the property removed from the market or sold through another route). No refunds will be offered for temporary or permanent loss of Service howsoever arising, including but not limited to a loss of Service due to the Property Browser website being unavailable for whatever reason. No refunds will be given if we delete your property as a result of you not renewing it. This does not affect your statutory rights as a consumer. Limitation of Liability Property Browser reserves the ultimate discretion as to which adverts, if any, are in
violation of these terms. Property Browser reserves the right to alter these
terms at any point and without notification.
These Terms represent the entire agreement between Property Browser and you
and all warranties and representations save as are expressly set out in
these Terms are hereby excluded, to the extent permitted by law. These
Terms shall be governed by the laws of England and Wales and the parties
hereby submit to the exclusive jurisdiction of the English Courts.
